Terms of Services

By using our Service, you are agreeing to these Terms of Service ("Terms"). If you are using the Service on behalf of an organisation or entity ("Organisation"), then you are agreeing to these Terms on behalf of the Organisation. In that case, "you" and "your" may refer to the Organisation.

Please read these terms carefully before you start using our Service.

Change of Terms of Service

From time to time, ILM P/L may modify existing terms and/or update these terms with additional terms that apply to the Service. For example, ILM P/L may modify existing terms to reflect any mandatory changes to the law.

ILM P/L will also post notice of modification to these Terms on this page or via the email address you registered with us, Your continued use of the Service constitutes your acceptance of any changes made to the Terms.

You should discontinue your use of our Service if you do not agree with updated/modified Terms.

Privacy Protection

ILM P/L's privacy policy explains how we treat your personal data and protect your privacy when using our Service. By using our Service, you automatically agree to our privacy policy and ILM P/L can use such data in accordance with its privacy policy.

Use of third-party applications

If you elect to utilise any third party application in connection with your use of the Service, by doing so you are consenting to your Content being shared with such third party application.

To understand how such third party application provider utilises your Content and other information, you should review their privacy policy.

Payment, Refunds, Upgrading and Downgrading

The Service is billed in advance on a monthly or annual basis and is non-refundable. There will be no refunds or credits for partial months of service, upgrade/downgrade refunds, or refunds for months unused with an active account.

If at any point you attempt to increase the number of users above your current ILM P/L plan threshold, you'll be advised that you first need to upgrade your plan.

Cancellation and Termination

You are solely responsible for properly cancelling your account. An email request to cancel your account is not considered cancellation. Any account Owner can cancel their account at any time by clicking the "Cancel Subscription" button in the Billing section within ILM P/L.

If you cancel the Service before the end of your current paid up month or year, your cancellation will be scheduled for the end of that billing period. No refunds will be given for the remainder of the 'paid for' period.

Modifications to the Service

ILM P/L reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice.

Copyright and Content Ownership

You may not duplicate, copy, or reuse any portion of the HTML/CSS/JS or visual design elements without express written permission from ILM P/L.

By using the Service, you grant ILM P/L access to your project data for the purposes of the running of this Service, but in no way is ILM P/L responsible for this data.

Limited Liability for Our Service

To the maximum extent permitted by law, the Service is available "as is". You expressly understand and agree that:

ILM P/L and its service partners, licensors, employees, agents will not be responsible for any lost profits, revenues, or data, financial losses or indirect, special, consequential, exemplary, or punitive damages under any circumstances.

Your use and/or purchase of the service are all at your sole risk. The service is provided on an "as is" basis.

ILM P/L DOES NOT warrant that:

The service will meet all of your requirements at all times;

The service will be error-free and all errors in the service will be corrected;

The service will be uninterrupted.

All content downloaded, uploaded and/or otherwise obtained through the use of the service is done at your own discretion and risk and you are soley responsible for any damage to hardware, or any loss of data.

Privacy Policy

Overview

The Data we collect depends on how our Services are used. Sometimes we receive Data directly, such as when a Gosubmit account is created, or during user interactions with our Services by, for example, using technologies like cookies. We also get Data from third parties, like our payment processing partners or in app customer chat service partners.

The collection and use of data from a variety of sources is essential to our ability to provide our Services.

Data We Collect

Registration and Contact Information. We collect information about you when you (a) register to use the Services and (b) otherwise provide contact information to us via email, mail, or through our Offerings. This information you provide may include your username, first and last name, email address, or mailing address.

Payment Information. When you purchase the Services, we will also collect transaction information, which may include your credit card information, billing and mailing address, and other payment-related information (“ Payment Information”). We describe how Payment Information may be collected and processed in Section 5.

Technical and Location Information. We automatically collect information on how you interact with the Offerings, such as the IP address from which you access the Offerings, date and time, information about your browser, operating system and computer or device, pages viewed and items clicked. We may also collect location information, including location information automatically provided by your computer or device. We use cookies and similar technologies to collect some of this information. For more information, please see our Cookie Policy outlined in section 10.

Usage. In using the Service you may input various types of content, including but not limited to: documents, attachments, emails, project names, team names, and conversations (together, the "Content").

Third Party Platforms. We may collect information when you interact with our advertisements and other content on third-party sites or platforms, such as social networking sites. This may include information such as “Likes”, profile information gathered from social networking sites or the fact that you viewed or interacted with our content.

How We Use the Data We Collect

We use your information in the following ways:

To provide, maintain and improve the Offerings and our other products and services, including to operate certain features and functionality of the Offerings (for example, by remembering your information so that you will not have to re-enter it during this or subsequent visits);

To process your inquiries and otherwise deliver customer service;

To process your payments, we share and use Payment Information as described in Section 5 (Payment Information);

To analyse trends, administer or optimize the Offerings, monitor usage or traffic patterns (including to track users’ movements around the Offerings) and gather demographic information about our user base as a whole;

To communicate directly with you, including by sending you newsletters, promotions and special offers or information about new products and services. Your opt-out options for promotional communications are described in Section 6 (Your Controls and Choices);

To deliver you advertising, including by serving and managing ads on the Offerings or on third party sites and to tailor ads based on your interests and browsing history. Please see Section 6 (Your Controls and Choices) for additional information on how to manage the ads you see.

Sharing Your Information With Third-Parties

We do not sell, trade, share or transfer your personal information to third parties except in the following limited circumstances:

To provide services that help us with our business activities, which may include assisting us with customer communications, monitoring trends, automating communication between systems, processing financial data, or providing, maintaining and improving the features and functionality of the Offerings, among other things;

To detect or prevent fraud or security issues, we may share your personal information with third parties (including our service providers and government entities);

If we become involved in a merger, acquisition, bankruptcy, or any form of sale of some or all of our assets;

If we have your consent we may share your personal information with a third party.

We may also share aggregated or anonymized information with third parties for other purposes. Such information does not identify you individually, but may include usage, viewing and technical information such as the types of Offerings our customers and users generally use, the configuration of their computers, and performance metrics related to the use of Offerings which we collected through our technology. If we are required under applicable law to treat such information as personal information, then we will only disclose it as described above. Otherwise we may disclose such information for any reason.

Payment Information

When you make a purchase on the Offerings, any credit card information you provide as part of your Payment Information is collected and processed directly by our payment processor Stripe through their Stripe Checkout service. We never receive or store your full credit card information. Stripe commits to complying with the Payment Card Industry Data Security Standard (PCI-DSS) and using industry standard security. Stripe may use your Payment Information in accordance with their own Privacy Policy here:

Your Controls and Choices

Opt-Outs. We may provide you with the opportunity to “opt-out” of having your personal information used for certain purposes when we ask for this information. If you decide to opt-out, we may not be able to provide certain features of the Offerings to you.

Communication Preferences. If you no longer wish to receive our newsletter and promotional communications, you may opt-out of receiving them by following the instructions included on such communications or on the Offerings. Please note, however, that you may be unable to opt-out of certain service-related communications.

Blocking Cookies. You can remove or block certain cookies using the settings in your browser but the Offerings may cease to function properly if you do so. For more information, please see Gosubmit's Cookie Policy in section 10.

Accessing and Updating Your Personal Information

When you use the Offerings, we make good faith efforts to provide you with access to your personal information upon your request and either provide you the means to correct this information if it is inaccurate or to delete such information at your request if it is not otherwise required to be retained by law or for legitimate business purposes. You may access, review, correct, update, change or delete your information at any time. To do so, please contact us at support@gosubmit.io with your name and the information requested to be accessed, corrected or removed, or if you are using the Service, sign in to your account, go to your profile, and make the desired changes. We may decline to process requests that are unreasonably repetitive or systematic, require disproportionate technical effort (for instance, requests concerning information residing on backup tapes), jeopardize the privacy of others, would be extremely impractical, or for which access is not otherwise required. In any case where we provide information access and correction, we perform this service free of charge, except if doing so would require a disproportionate effort.

Please note that if you cease using the Service or we terminate your access to the Service in accordance with your Customer Agreement, you may no longer have the ability to access or update your information.

We may retain your information as necessary to support the Offerings, comply with our legal obligations or resolve disputes. Note that content you post may remain on the Offerings even if you cease using the Offerings or we terminate your access to the Offerings.

Security

When you enter sensitive information (such as your password), we encrypt that information in transit using industry-standard Transport Layer Security (TLS) encryption technology. No method of transmission over the Internet, method of electronic storage or other security methods are one hundred percent secure. Therefore, while we strive to use reasonable efforts to protect your personal information, we cannot guarantee its absolute security.

No Children Under the Age 13

The Services are not directed to individuals under the age of thirteen (13), and we request that they not provide Personal Data through the Services.

Cookies Policy

We use and allow certain other companies to use cookies, and other similar technologies (collectively “Cookies”) on our Services. We do this to understand your use of our Services; improve your user experience and enable personalized features and content; optimize our advertisements and marketing.

We reserve the right to change our Privacy Policy at any time. If we make changes, we will post them and will indicate on this page the policy’s new effective date. If we make material changes to this policy, we will notify you by email or through notice on the Offerings.
